Plaintiff appeals from so much of an order of the Civil Court of the City of New York, New York County (Jeffrey K. Oing, J.), entered March 21, 2008, as granted defendant's motion for summary judgment dismissing his complaint.

Order (Jeffrey K. Oing, J.), entered March 21, 2008, affirmed, with $10 costs, for the reasons stated by Jeffrey K. Oing, J. at Civil Court. ( See Thompson v Grumman Aerospace Corp., 78 NY2d 553, 557-558; cf. Smith v Pizza Hut of Am., Inc., 289 AD2d 48).
