ORDER


AND NOW, this 10th day of August, 2007, upon consideration of petitioner Rodney Leadum's Petition for Writ of Habeas Corpus, the Commonwealth's Response, and the whole record, after review of the Report and Recommendation of Magistrate Judge Carol Sandra Moore Wells and consideration of petitioner's objections thereto, and for the reasons stated in the court's accompanying memorandum, it is hereby ORDERED that:

1. The petitioner's objections are OVERRULED;
2. The Report and Recommendation is APPROVED and ADOPTED;
3. The Petition for Writ of Habeas Corpus is DISMISSED and DENIED without an evidentiary hearing;
4. There is no probable cause to issue a certificate of appealability; and
5. The Clerk of the Court shall mark this case closed for statistical purposes.
