UNG T. LE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 292nd Judicial District Court Dallas County, Texas
Trial Court Cause No. F13-53089-V

ORDER

We REINSTATE this appeal.

Because appellant's brief had not been filed and we had no communication regarding the brief, we abated this appeal for a hearing. On June 14, 2017, we received the supplemental record with the trial court's findings and recommendations made that same day. We ADOPT the trial court's finding that (1) appellant desires to prosecute the appeal, (2) appellate counsel Michael Todd was retained by appellant's sister to represent him at trial but has not paid him to represent appellant on appeal; (3) appellant is indigent and cannot afford legal counsel; and (4) the trial court appointed John Tatum to represent appellant on appeal.

The Clerk is DIRECTED to remove Michael Todd as counsel. John Tatum is now counsel of record. All future correspondence shall be sent to John Tatum, Summit Park, 2150 S. Central Expressway, Suite 200, McKinney, TX 75070.

We ORDER appellant's brief due THIRTY DAYS from the date of this order.

We DIRECT the Clerk to send a copy of this order to Michael Todd, John Tatum, and the Dallas County District Attorney's Office.
