An appeal and cross appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about March 8, 2019, And defendant/counterclaim-plaintiff-appellant-respondent having moved for an extension of time to perfect the appeal and cross appeal (M-8835), Now, upon reading and filing the correspondence from counsel for defendant/counterclaim-plaintiff-appellant-respondent dated December 16, 2019, and the correspondence from counsel for third-party defendant-respondent-appellant S2 Filings, LLC, dated December 27, 2019 (M-109), and due deliberation having been had thereon, It is ordered that the motion (M-8835), the appeal and the cross appeal are withdrawn in accordance with the aforesaid correspondence.
