Plaintiff having moved for an extension of time to perfect the cross appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on June 10, 2013,

Now, upon reading and filing the affidavit of John A. Collins, Esq., sworn to March 28, 2014, the notice of motion with proof of service thereof, and the affirmation of James P. Renda, Esq., received April 10, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and plaintiff shall perfect the cross appeal on or before June 16, 2014, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
