Appellant having moved to consolidate the appeals taken herein from an order, an order and judgment, and a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on March 30, 2012 (appeal No. 1), April 16, 2012 (appeal No. 2), and June 10, 2013 (appeal No. 3), and having moved to extend the time to perfect appeal Nos. 1 and 2,

Now, upon reading and filing the affidavit of James P. Renda, Esq., sworn to January 3, 2014, the notice of motion with proof of service thereof, and the affidavit of John A. Collins, Esq., sworn to January 9, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed without prejudice to a motion to vacate the dismissal of appeal Nos. 1 and 2 (see 22 NYCRR 1000.13 [g]) and to consolidate the appeals.
