Amanda Nicole LAWSON, Appellant v. The STATE of Texas, Appellee

From the 187th Judicial District Court, Bexar County, Texas Trial Court No. 2019CR8173 Honorable Stephanie R. Boyd, Judge Presiding

ORDER

Beth Watkins, Justice

On November 22, 2024, appellant's appointed counsel, H. Todd McCray, filed a "Motion for Leave to Withdraw and Stay Filing of Appellant's Brief." In the motion, Mr. McCray explained that he must withdraw from representing appellant because he has been elected to serve on this court and is scheduled to take his oath of office on January 1, 2025. The motion further requested a stay of appellant's briefing deadline until after substitute appellate counsel has been appointed. Neither the State nor appellant filed any opposition to the motion.

We GRANT the motion and ORDER H. Todd McCray withdrawn as the attorney of record for appellant in this appeal. We ABATE the appeal and remand this matter to the trial court. We ORDER the trial court to appoint new appellate counsel to represent appellant by December 17, 2024. We further ORDER the trial court clerk to file a supplemental clerk's record containing the order appointing new appellate counsel by December 23, 2024. Appellant's brief will be due 30 days after new appellate counsel is appointed.
