MEMORANDUM OPINION


On October 18, 2005, this Court granted appellant Roger H. Lawler a second extension to file his brief, making his brief due no later than November 11, 2005. When appellant had not filed his brief by December 6, 2005, we notified him by letter that his brief was overdue. We directed appellant to file a brief and extension motion within ten days or the appeal would be dismissed.

As of today's date, appellant has not filed a brief or extension motion nor has he otherwise communicated with this Court regarding this appeal. Under these circumstances, we DISMISS the appeal. See Tex.R.App.P. 38.8(a)(1); 42.3(b), (c).
