ORDER TO SHOW CAUSE

This case was called from the calendar of the Court's November 13, 2023 trial session for Houston, Texas. There was no appearance by or on behalf of petitioner. Respondent appeared and was heard. During the calendar call, respondent notified the Court that petitioner recently informed respondent's counsel that petitioner no longer resides in Texas.
Prior to calendar call, on October 23, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. The Court will direct petitioner to show cause why the Court should not grant respondent's Motion. If petitioner has moved from the address provided on the Petition, petitioner's response shall include: (1) petitioner's current address (preferably by completing and submitting Form 10); and (2) place for trial (preferably by completing and submitting Form 5). Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed October 23, 2023, is taken under advisement. It is further
ORDERED that, on or before December 4, 2023, petitioner shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution should not be granted and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioner. It is further
ORDERED that the Clerk of the Court shall serve a copy of Form 10, Notice of Change of Address and Form 5, Request for Place of Trial, on petitioner. It is further
ORDERED that the undersigned retains jurisdiction of this case.
