ORDER DISMISSING APPEAL


Upon review of the record, it appears that a judgment resolving all claims against all the parties has not been entered in Civil No. 97-0234 pursuant to HRCP 58. See Jenkins v. Cades Schutte Fleming Wright, 76 Haw. 115, 119-120, 869 P.2d 1334, 1339-39 (1994). Thus, the appeal of the June 5, 2001 judgment and the November 4, 1998 summary judgment order is premature and we lack jurisdiction. Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.
