ORDER


After making an independent review of the pleadings, files, and records in this case, and the August 26, 2002 findings and recommendation of the magistrate judge, the court concludes that the findings and conclusions are correct and are therefore adopted.

The following motions to dismiss are denied without prejudice to being reurged after plaintiff files the RICO case statement required by the August 26, 2002 order of the United States Magistrate Judge; defendant Maria N. Steigenberger's August 16, 2002 motion to dismiss, and defendants State Bar of Texas and Tony Alvarado's August 16, 2002 motion to dismiss for failure to state a claim and failure to properly plead, or in the alternative, motion for more definite statement. Nothing in this order precludes a defendant from filing any other dispositive motion after the RICO case statement is filed and no later than any motion deadline prescribed by the Federal Rules of Civil Procedure or by order filed in this case.
