Judgment and order affirmed, with costs. All concurred, except McLennan, P.J., who dissented on the ground that there is no evidence that the alleged failure of the defendant to perform his contract resulted in damage to the plaintiff, and on the further ground that plaintiff waived any such breach on the defendant's part.
