PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

An appeal having been taken from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on October 9, 2012, and an order having been entered January 14, 2013, assigning Paul B. Watkins, Esq., to conduct the appeal and permitting appellant to appeal as a poor person,

Now, on the Court's own motion,

It is hereby ORDERED that the order entered January 14, 2013, is vacated to the extent that it assigns Paul B. Watkins, Esq., to conduct the appeal, and

It is further ORDERED that Charles T. Noce, Esq., Monroe County Conflict Defender, 80 West Main Street, Suite 300, Rochester, New York 14614, is hereby assigned to conduct the appeal, and

It is further ORDERED that the Clerk of the Family Court, Monroe County, provide Charles T. Noce, Esq., with copies of all papers and stenographic transcripts of the proceedings upon which the appeal is based.
