Present — Cohn, J.P., Callahan, Van Voorhis, Shientag and Foster, JJ.


Order unanimously modified by changing item 10 to read as follows: "As to the plaintiff's knowledge prior to the delivery of the notes of the facts, circumstances and conditions under which said notes had been delivered to the said Thomas Potter between August 3, 1946 and November 1, 1946, or any time thereafter" and, as so modified, affirmed, without costs. The date for the examination to proceed shall be fixed in the order. Settle order on notice.
