ORDER DENYING PETITION

This is an original petition for a writ of mandamus and/or prohibition seeking an order directing the district court clerk to provide petitioner Justin Odell Langford with a copy of his presentence investigation report (PSI). Langford asserts he previously requested a copy of the PSI from the district court clerk, but he was informed the PSI was sealed and a court order was required to reproduce it. Langford has provided this court with a copy of a district court order that grants his motion to obtain a copy of a sealed record. Langford asserts that, because the district court clerk provided him with the copy of the order granting his motion to obtain a sealed record, the clerk is aware of the order and should have provided him with a copy of his PSI upon request. Langford has not provided this court with a copy of the letter he sent to the district court clerk requesting a copy of his PSI. Therefore, it is unclear whether Langford referenced, or provided a copy of, the order granting his motion to obtain a copy of a sealed record when he requested the PSI.

We conclude Langford has failed to demonstrate our intervention by way of extraordinary writ is warranted at this time. See Pan v. Eighth Judicial Dist. Court, 120 Nev. 222, 228, 88 P.3d 840, 844 (2004) ("Petitioner[ ] carr[ies] the burden of demonstrating that extraordinary relief is warranted."). Specifically, it appears Langford has a plain, speedy, and adequate remedy available to him, see NRS 34.170; NRS 34.330, because he can resubmit his request for his PSI to the district court clerk, along with a copy of the order granting him permission to obtain a sealed record. Accordingly, without deciding upon the merits of the claim raised, we

ORDER the petition DENIED.
