Decided November 29th, 1939.

Easement of Light — Injunction against Obstruction.

In a suit to enjoin the obstruction of an implied easement for light received by a window in an areaway between plaintiff's and defendant's residences, held that a decree in favor of plaintiffs, forbidding any structure that walls off the light and air received by such window "from exposure in a half circle or more," was properly expressed, the quoted language being merely intended to emphasize the statement of the condition that no structure in the areaway should interfere with the light to that (east) window of the plaintiffs' house, coming from the right, front, left, or from above, as now existent.

Decided November 29th, 1939.

Appeal from the Circuit Court for Frederick County, In Equity (DELAPLAINE, C.J., and WILLARD, J.).

Bill by Gilmore F. Flautt and Ruth R. Flautt, his wife, against Charles S. Lane, III, and Susan Gambrill Lane, his wife. From the decree rendered, defendants appeal. Affirmed.

The cause was argued before BOND, C.J., OFFUTT, SLOAN, MITCHELL, SHEHAN, and JOHNSON, JJ.
