Landry v. City of Lafayette

Court of Appeal of Louisiana, Third Circuit
Dec 24, 1975
324 So. 2d 553 (La. Ct. App. 1975)

Opinion

No. 5287.

December 24, 1975.

APPEAL FROM 15TH JUDICIAL DISTRICT COURT, PARISH OF LAFAYETTE, STATE OF LOUISIANA, HONORABLE DOUGLAS J. NEHRBASS, J.

White Pitre by Joshua Pitre, Opelousas, Murphy W. Bell, Baton Rouge, for plaintiffs-appellants.

L. H. Oliver, Lafayette, for defendants-appellees.

Before MILLER, WATSON and CUTRER, JJ.

Plaintiffs, the children of Norbert Landry, appeal the dismissal of their claim for their father's death. He was killed in a gun battle with defendants who were Lafayette police officers. The city and its insurer were also made defendants. We affirm.

This case was consolidated for trial and appeal with Landry v. City of Lafayette, 324 So.2d 550 (La.App. 3 Cir. 1975) handed down this date. For reasons assigned in that opinion, the trial court judgment is affirmed at appellants' costs.

Affirmed.
