Appeal from the 158 District Court of Denton County, Texas (TC# F-2010-1639-B) ORDER
The briefs have been filed in the above-styled and numbered cause. On December 30, 2014, the Court granted David L. Richards' motion to withdraw and substitute Tim Choy as counsel for Appellant. Appellant subsequently filed a response which we have construed as a motion to reconsider. In addition to vigorously objecting to the substitution of Mr. Choy as appellate counsel, Appellant requests that we abate the appeal for ninety days in order for him to retain new counsel and permit him to file an amended brief when the appeal is reinstated. Mr. Choy has expressed a willingness to remain appellate counsel until Appellant has secured new counsel, but Appellant has not withdrawn his objection to Mr. Choy. Accordingly, the motion to reconsider is granted to the extent that we withdraw the portion of our prior order permitting Mr. Choy to substitute as counsel for Appellant. Further, we abate the appeal for ninety days to give Appellant an opportunity to retain appellate counsel. The Court will consider a motion to file an amended brief after the appeal is reinstated. All other relief requested in the motion to reconsider and not expressly granted in this order is denied.
IT IS SO ORDERED this 9 day of February, 2015.
PER CURIAM Before McClure, C.J., Rodriguez and Hughes, JJ.
