Opinion
November 16, 1949.
Appeal from Supreme Court, Clinton County.
Present — Foster, P.J., Brewster, Deyo, Santry and Bergan, JJ.
Each of the plaintiffs brought an action to recover damages for personal injuries which she received when struck by an automobile while she was crossing Montcalm Avenue in the city of Plattsburgh. Montcalm Avenue runs north and south. The plaintiffs, who are twelve and fourteen years of age respectively, were crossing the street from east to west, and as they had almost reached the westerly curb they were struck by an automobile going north. The automobile did not stop but continued northerly on its way. The defendant denied that he was involved in the accident. On conflicting testimony the jury resolved the issues against the defendant. There was sufficient evidence to support the verdicts of the jury. Judgments unanimously affirmed, with one bill of costs and disbursements.
