ORDER

After this court issued an order on September 19, 2013, ordering appellant to file his brief on or before October 25, 2013, and advising appellant that no further extensions would be granted in the absence of written proof of extraordinary circumstances, appellant filed a motion to extend time to file the brief. It appears this court's order and appellant's motion crossed in the mail. It appears appellant was asking for an extension from the September due date. We attempted to contact appellant's counsel to clarify his request, but had to leave a message. Counsel has not responded to the message. Accordingly, we DENY appellant's motion as MOOT. Appellant's brief is due, per this court's September 19, 2013 order, on or before October 25, 2013.
