ORDERED that defendant's motion to dismiss or in the alternative for summary judgment [#16] is granted in part and denied in part. It is further

ORDERED that plaintiff's motion for summary judgment [#17] is granted in part and denied in part. It is further

ORDERED that this matter is remanded to the Coast Guard for further proceedings consistent with this Court's ruling.
