Motion No: 516176
04-11-2013
ROBERT C. LAITY, Appellant, v. STATE OF NEW YORK, Respondent. (And Another Action.)
DECISION AND ORDER ON MOTION
Motion to accept record on appeal without stipulation.
Upon the papers filed in support of the motion and the papers filed in response thereto, it is
ORDERED that the motion is denied, without costs, on the ground that the appeals are separate and must be perfected on separate records on appeal and briefs. In the event that the parties are unable to agree to the proper content of the separate records on appeal, appellant should move in the courts of original instance to settle the records on appeal.
PETERS, P.J., LAHTINEN, SPAIN, McCARTHY and EGAN JR., JJ., concur.
