This case was calendared for a remote trial at the session of the Court scheduled to commence on October 18, 2021, for cases in which Dallas, Texas, was the place of trial.
On October 13, 2021, the Court conducted a conference call with the parties. During that conference call, the parties represented to the Court the parties' views on the remaining issues in the case and whether a trial would be necessary or helpful to address the remaining issues. Additionally, the parties indicated to the Court that they would contact the chambers of the undersigned regarding whether the parties would be filing any motion to submit this case pursuant to Rule 122, Tax Court Rules of Practice and Procedure, or if they had otherwise agreed on a plan to resolve or address the remaining issues. On October 15, 2021, the Court issued an order striking this case from the Court's October 18, 2021, remote trial session and the undersigned retained jurisdiction. The Court did not receive any call from the parties.
During the weeks of October 18 and October 25, 2021, a representative of the Court attempted to schedule an additional conference call with the parties. Due to the Court's continuing inability to reach counsel for petitioner, the Court was unable to schedule an additional conference call with the parties.
Accordingly, it is
ORDERED that, on or before November 10, 2021, the parties shall file a joint status report reflecting the then-present status of this case. 1
