Before this Court is the appellant's December 7, 2023 motion requesting we abate these appeals to the trial court and order the trial court to supplement the appellate record with the transcripts from pretrial hearings. Appellant points out the reporter's record in case F21-61853 (05-23-00748-CR) does not include pretrial hearings that were conducted, according to the trial court's minutes, on January 10, and 31, 2023; February 8 and 20, 2023; March 6 and 20, 2023; April 11 and 26, 2023; May 10 and 25, 2023; June 2, 2023; as well as the plea hearing, sentencing, and advising of appellant's appellate rights, beginning and concluding on June 29, 2023.
Accordingly, we GRANT appellant's motion and ORDER the trial court to conduct a hearing within THIRTY DAYS of the date of this order and make findings of fact regarding whether the trial court conducted any pretrial hearings or other hearings, including on the dates mentioned above, the subject of the hearings, and the name of the court reporter at each hearing. We ORDER the trial court to transmit a record of the proceedings within FORTY DAYS of this order. We further ORDER the trial court to inform this Court when the respective court reporter will file a supplemental reporter's record of each hearing.
We DIRECT the Clerk to send copies of this order to the Honorable Tina Clinton, Presiding Judge, Criminal District Court One, and counsel for all parties.
This appeal is ABATED for the trial court to comply with this order. The appeal will be reinstated when the Court receives the trial court's findings or at such other time as the Court deems appropriate.
