DECISION & ORDER ON MOTION

Motion by the appellant to for leave to appeal to the Court of Appeals from a decision and order of this Court dated March 13, 2012, which determined an appeal from a judgment of the Supreme Court, Dutchess County, dated July 13, 2010. Cross motion by the respondent for leave to reargue the appeal, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion and cross motion are denied.
