ORDER


The magistrate judge's report and recommendation in this matter was filed on December 13, 2002. No objections being filed, final judgment was entered on January 15, 2003. On January 16, 2003, plaintiff filed untimely objections to the magistrate judge's report and recommendation.

The court construes plaintiff's objections as a timely motion for a new trial. The court has further conducted a de novo review of the objections in relation to the pleadings and the applicable law. See FED. R. CIV. P. 72(b). After careful consideration, the court concludes the objections are without merit as to the ultimate recommendation of the magistrate judge. It is therefore

ORDERED that plaintiff's motion for a new trial is DENIED.
