Leave to Appeal Granted December 3, 1997.
Leave to file a brief amicus curiae is also granted. The parties are directed, and the amicus curiae is invited, to additionally brief: (1) If the mobile home's present market value is less than the total of plaintiff Ladd's down payment and the defendant's perfected lien, does the rule adopted in the Court of Appeals opinion mean that, in the absence of a special arrangement, plaintiff Ladd would forfeit part or all of his down payment? (2) Does the rule adopted in the Court of Appeals opinion mean that a retail purchaser who paid the full price of the mobile home in cash would forfeit that payment up to the amount of the secured lien held by the floor plan financier?
