DONNA LACOUR, IN HER CAPACITY AS EXECUTRIX OF SUCCESSION OF JOHNYE MAE MADDEN, JAMES D. MADDEN, LYDIA ROBERTS MADDEN v. MARY ELIZABETH CHUMLEY

Appealed from Webster Parish No. 80169

Before STONE, HUNTER, and MARCOTTE, JJ.

ORDER

Mary Elizabeth Chumley has appealed the district court's November 27, 2023, ruling partially granting the Motion for Summary Judgment filed by Donna LaCour. The district court certified the judgment being appealed as a partial final judgment pursuant to La. C.C.P. art. 1915(B) and indicated that there were no just reasons to delay an appeal of the same. However, the district court failed to include in that judgment express reasons for its determination that there is no just reason for delay as required under the law. See, R.J. Messinger, Inc. v. Rosenblum, 04-1664 (La. 3/2/05), 894 So.2d 1113. The district court is hereby ordered to supplement the record within 30 days of this order with a per curiam opinion setting forth the reasons for its finding that no just reason for delay existed and for certifying the judgment appealed as a partial final judgment under La. C.C.P. art. 1915(B).
