ORDER DENYING MOTION TO DISMISS APPEAL


Upon consideration of appellee's motion to dismiss appeal, the papers in support and in opposition and the record, it appears that the circuit court granted the claimant's motion to confirm the December 20, 2001 arbitration award such that the March 7, 2002 order granting confirmation of the award is an appealable judgment under HRS § 658-12. The March 7, 2002 order granting the motion for stay of proceedings stays the enforcement of the March 7, 2002 judgment. The stay of the enforcement of the March 7, 2002 judgment does not affect the finality of the judgment for purposes of appeal. Therefore,

IT IS HEREBY ORDERED that the motion to dismiss appeal is denied.
