GUSTAVE J. LABARRE, JR. v. OCCIDENTAL CHEMICAL COMPANY AND TEXAS BRINE COMPANY, LLC

In Re: Liberty Insurance Underwriters, Inc., applying for supervisory writs, 23rd Judicial District Court, Parish of Assumption, No. 33796.

BEFORE: McDONALD, CRAIN, AND DRAKE, JJ.

MOTION FOR STAY DENIED. WRIT DENIED. To the extent that the trial court issued a preliminary injunction, any issues regarding the propriety of the TRO, other than relator's claim for damages and attorney fees for the wrongful issuance of the TRO, are moot. Since the trial court did not rule on that claim, we find that the issue of damages and attorney fees remains open for consideration by the trial court.
