GUSTAVE J. LABARRE, JR. v. OCCIDENTAL CHEMICAL COMPANY AND TEXAS BRINE COMPANY, LLC


In Re: Texas Brine Company, LLC, applying for supervisory writs, 23rd Judicial District Court, Parish of Assumption, No. 33796. BEFORE: DRAKE, HOLDRIDGE AND CHUTZ, JJ.

WRIT GRANTED. We grant the writ and reverse the September 21, 2015 judgment of the trial court denying relator's, Texas Brine Company, LLC's motion to compel deposition testimony of the LaBarre plaintiffs. Relator-defendant has the right to discover relevant information that is reasonably calculated to lead to the discovery of admissible evidence, including evidence of respondents' credibility and veracity. See La. Code Civ. P. art. 1422; Lehmann v. American Southern Home Ins. Co., 615 So.2d 923 (La. App. 1st Cir. 03/05/93), writ denied, 617 So.2d 913 (La. 1993); Page v. Guidry, 506 So.2d 854 (La. App. 1st Cir. 1987). Accordingly, it appears that certain information requested by the relator may lead to the discovery of admissible evidence. Therefore, the relator's motion to compel deposition testimony is granted. In order to ensure that only discoverable information is obtained at the deposition, the relator shall take any depositions concerning the requested information upon written questions in accordance with La. Code Civ. P. art. 1448.
