ORDER


AND NOW, this ____ day of ____, 2004, after review of the pleadings and record herein, and upon consideration of the Report and Recommendation of United States Magistrate Judge Charles B. Smith, it is hereby ORDERED that:

1. The Report and Recommendation is APPROVED and ADOPTED.

2. The petitioner's Petition for Writ of Habeas Corpus, pursuant to 28 U.S.C. § 2241, is GRANTED.

3. The government is DIRECTED to RELEASE petitioner on an order of supervision, pursuant to 8 C.F.R. § 241.5, on such terms and conditions dictated by the District Director for Pennsylvania of the Department of H omeland Security, Bureau of Immigration and Customs Enforcement.

It is so ORDERED.
