LOS ANGELES TIMES COMMUNICATIONS LLC v. STATE BAR OF CALIFORNIA (GIRARDI)
Supplemental briefing ordered
On October 7, 2022, the State Bar filed a supplemental brief in this matter, in which it represented to the court that it (1) has changed its position on the second of the three issues set forth in this court's September 1, 2021 order; (2) intends "to release information about past disciplinary investigations concerning Mr. Girardi" to the extent it believes it is permitted to do so according to section 6086.1, subdivision (b)(2) of the Business and Professions Code; and (3) will do so no later than 30 days after the date of its supplemental brief, absent contrary direction from this court. Petitioner Los Angeles Times Communication, LLC responded on October 11, 2022, contending this case continues to present issues "of public significance" for which "there is a need for clarification of the law."
Consistent with the representations offered by the State Bar in its supplemental brief, we expect that it will disclose the information referred to therein to the petitioner as soon as possible, and no later than November 7, 2022. The parties are hereby directed to meet and confer promptly after that date and to file briefs apprising the court of their respective positions on the issues set forth in this court's September 1, 2021 order. The parties should attach or otherwise file copies of the disclosures made by the State Bar insofar as the parties disagree about the scope of the disclosures. Petitioner shall serve and file its brief within seven days of receiving these disclosures from the State Bar. The State Bar shall serve and file a responsive brief within seven days after the timely filing of petitioner's brief.
