Appellant filed a notice of appeal in the underlying cause on December 22, 2015, and a clerk's record was filed on December 23, 2015. The clerk's record did not contain a judgment, and the trial court clerk verbally confirmed no judgment had been signed. On December 28, 2015, appellant was ordered to show cause in writing by January 12, 2016, why this appeal should not be dismissed for lack of jurisdiction because the notice of appeal was prematurely filed. Appellant did not respond to this court's order. Although a supplemental clerk's record was filed on January 8, 2016, containing an order signed by the trial court denying appellant's motion for new trial, the trial court clerk again verbally confirmed no judgment has been signed.
Because the trial court has not signed a judgment documenting that a sentence has been imposed or suspended in the underlying cause, we do not have jurisdiction to consider this appeal. Accordingly, this appeal is dismissed for lack of jurisdiction without prejudice to appellant pursuing an appeal after a judgment is entered.
