Landlord appeals from an order of the Civil Court of the City of New York, New York County (Michelle D. Schreiber, J.), dated September 14, 2012, which granted tenant's motion to dismiss the holdover petition and for Rule 130 sanctions, and denied as moot landlord's cross motion for summary judgment.

Order (Michelle D. Schreiber, J.), dated September 14, 2012, affirmed, with $10 costs, for the reasons stated by Michelle D. Schreiber, J. at Civil Court.
