Appeal from an order of the Supreme Court, Erie County (Rose H. Sconiers, J.), entered July 28, 2004. The order granted the motions of defendants Carl R. Critoph, Russell O. Critoph, Richard E. Malicki, Jr. and Ford Motor Company (also sued incorrectly herein as Buffalo Stamp Plant) and the cross motion of defendant Jennifer M. Roll for summary judgment dismissing the amended complaint and cross claims against them and granted plaintiff's cross motion for partial summary judgment against defendants Scott J. Schappert and Elaine M. Schappert.
