We think that the allegations in paragraph 4 of the complaint must be read with the allegations in paragraph 2 thereof, and the complaint as thus read states a cause of action. Judgment reversed and new trial granted, costs to abide the event. Bartlett, Jenks, Hooker, Rich and Miller, JJ., concurred.
