MARK R. KUMM, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER TO SHOW CAUSE

Cary Douglas Pugh Judge.

This case was called from the calendar of the Court's Milwaukee, Wisconsin trial session on June 12, 2023. Counsel for respondent appeared and was heard. There was no appearance by or on behalf of petitioner. Respondent orally moved to dismiss for lack of prosecution. We directed respondent to file a written motion.

On June 29, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. Upon due consideration and for cause more fully appearing in the transcript of the proceeding it is, ORDERED that, on or before August 14, 2023, petitioner shall show cause, in writing, why the Court should not grant respondent's June 29, 2023, Motion to Dismiss for Lack of Prosecution. Petitioner should explain in detail what caused him to miss trial (including appropriate documentation) and what steps he has taken to provide relevant documents to respondent's counsel and work with respondent's counsel to prepare his case for trial or other disposition.
