Appeal by the defendant City of New York from an interlocutory judgment of the Supreme Court, Queens County, entered August 28, 2009, which was decided by decision and order of this Court dated February 15, 2011.

Now, on the Court's own motion, it is

ORDERED that Michael Kuhland, as administrator to the estate of Derek W. Kuhland, is substituted for the deceased respondent Derek W. Kuhland, and the caption is amended accordingly.
