ORDER OF REINSTATEMENT

David Gunn, Judge

On May 30, 2024, the Court entered an order abating this appeal for referral to mediation. The Court further notified the parties that any party may file an objection to the referral to mediation, and if the Court concluded there was a reasonable basis for the objection, would sustain the objection and reinstate the appeal on the Court's active docket.

Appellee, Wanda Noskrent filed an "Objection to the Referral to Mediation." In her objection, Noskrent stated that mediation of this matter would be futile, as the "parties attended mediation before the trial and . . . [mediation] was not successful." She further states that "mediation during appeal is highly unlikely to produce any settlement and would be futile."

We conclude that there is a reasonable basis for the Noskrent's objection, sustain the objection, and reinstate the appeal on the Court's active docket.

It is so ORDERED.
