JADA KU, Plaintiff and Appellant, v. GREAT FALLS PUBLIC SCHOOLS, Defendant and Appellee.
ORDER
Self-represented Appellant Jada Ku (Ku) has filed a "Motion Requesting Interpreter/Advocator/Attorney" in her appeal of a decision from the Cascade County District Court. Through counsel, Great Falls Public Library (Library) responds in opposition, pointing out that Ku has litigated several proceedings at both the District Court and Supreme Court.
As the Library acknowledges, this Court addressed and denied Ku's similar motion in her other appeal. Ku v. Great Falls Public Library, No. DA 21-0111, Order (Mont. May 26, 2021).
Ku is not entitled to her requests here either. Ku represented herself in her underlying District Court cases as well as with the motions she has filed in this Court and has not demonstrated any need for an interpreter. Ku communicates well in English. This Court reiterates that it has no statutory authority to appoint counsel for Ku or to appoint an advocate in her pending appeal.
This Court cautions Ku to refrain from filing the same motions, requesting counsel or legal assistance, in either appeal. We have denied such requests, and we will not address any similar motions filed by Ku. Failure to adhere to this cautionary note may result in dismissal of this appeal. We further point out that Ku's opening brief is due on or before June 25, 2021. Accordingly, IT IS ORDERED that Ku's "Motion Requesting Interpreter/Advocator/Attorney" is DENIED and DISMISSED.
The Clerk of the Supreme Court is directed to file a copy of this Order in Ku's pending appeal, Ku v. Great Falls Public Library, Cause No. DA 21-0111.
The Clerk also is directed to provide a copy of this Order to counsel of record and to Jada Ku personally.
