Stanley Kruger, Plaintiff-Respondent, v. The City of New York, Defendant-Appellant.
Defendant-appellant having moved for an order staying the trial in the above-entitled action pending hearing and determination of the appeal taken from the order of the Supreme Court, New York County, entered on or about December 14, 2018, and said appeal having been perfected, Now, upon reading and filing the papers with respect to the motion, and the Stipulation Discontinuing Appeal dated September 20, 2019, and due deliberation having been had thereon, It is ordered that the appeal is deemed withdrawn pursuant to the stipulation and the motion is denied as academic.
