Dawn Marie Kroswek v. Stephen John Kroswek

LC No. 17-044784-DM

ORDER

Christopher M. Murray, Chief Judge, acting under MCR 7.203(F)(1), orders:

The claim of appeal is DISMISSED for lack of jurisdiction because neither the September 14, 2021 order nor the August 19, 2021 order is a final order as defined in MCR 7.202(6). MCR 7.203(A)(1). A postjudgment order regarding parenting time is not an order that grants or denies a motion to change legal custody, physical custody, or domicile under MCR 7.202(6)(a)(iii). Similarly, an order denying a motion for reconsideration of an order regarding parenting time does not satisfy any of the definitions in MCR 7.202(6). Dismissal is without prejudice to the filing of a late appeal under MCR 7.205(A)(4), provided such a filing meets all requirements under the court rules and is not time-barred.
