April 19, 1943.


Action by a wife to recover damages for injuries sustained by her as the result of a fall on a flight of stairs, caused by the alleged negligence of defendants, and by her husband for loss of services and for expenses. Judgment of the County Court, Westchester County, for plaintiffs, reversed on the law, with costs, and the complaint dismissed on the law, with costs. No actionable defect was proved. Hagarty, Carswell, Johnston and Adel, JJ., concur; Taylor, J., not voting.
