Order reversed on the law, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, on the ground that there is a failure to show special circumstances such as authorizes the examination of a witness under section 288 of the Civil Practice Act. Lazansky, P.J., Young, Carswell, Davis and Johnston, JJ., concur.
