ORDER

Christian N. Weiler, Judge

This case was called from the calendar of the Court's February 6, 2023, Chicago, Illinois trial session. There was no appearance by or on behalf of petitioner. Respondent appeared and orally moved the Court to dismiss the case for failure to properly prosecute. The Court and respondent's counsel made numerous efforts to reach the petitioner, but all attempts were unsuccessful. Respondent's motion to dismiss was taken under advisement and the Court issued an Order to Show Cause as to why respondent's motion should not be granted. Petitioner filed his response on March 16, 2023.

Upon due consideration, it is

ORDERED that respondent's motion to dismiss for failure to properly prosecute is hereby denied. It is further

ORDERED that the Order to Show Cause, served on February 9, 2023, is hereby discharged. It is further

ORDERED that the undersigned no longer retains jurisdiction, and this case is restored to the general docket.
