920 So. 2d 679 (Fla. Dist. Ct. App. 2006)

Opinion

No. 4D04-4177.

January 11, 2006. Rehearings Denied March 10 and 24, 2006.

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Jeffrey E. Streitfeld, Judge; L.T. Case No. 01-2448 14.

Don Kozich, Fort Lauderdale, pro se.

Guy W. Harrison and Edward Etcheverry of Etcheverry Harrison LLP, Fort Lauderdale, for appellee.

Appellant appeals the dismissal of his complaint against a bonding company. In his complaint he contended that his salary and benefits owed by his former employer, which was the insured under a payment bond, were covered by the provisions of the bond. We disagree, as the bond did not apply to his former employer's salaried administrators under either definition of "claimant" in the bond. We also affirm as to the remaining issues.

STEVENSON, C.J., WARNER and HAZOURI, JJ., concur.
