MEMORANDUM OPINION


On September 22, 2009, this Court granted appellants an extension of time until September 28, 2009 to file their brief. We warned appellants that failure to file their brief by that date would result in dismissal of the appeal without further notice. Appellants did not file their brief by September 28, 2009. The Court now has before it appellees' October 2, 2009 motion to dismiss the appeal due to appellants' failure to file their brief. Appellants did not respond to the motion, nor have they tendered a brief. Accordingly, we grant the motion and dismiss the appeal. See Tex. R. App. P. 38.8(a)(1), 42.3(c).
