Plaintiff-appellant, pro se, having moved for leave to prosecute, as a poor person, the appeal from an order of the Supreme Court, New York County, entered on or about September 29, 2016, and for leave to have the appeal heard on the original record and upon a reproduced appellant's brief, and for an enlargement of time to perfect the appeal, Now, upon reading and filing the papers with respect to said motion, and due deliberation having been had thereon, It is ordered that the motion is denied, with leave to renew, upon proof of service of the instant motion upon the defendant's New York counsel and upon plaintiff's submission of a CPLR 1101(a) affidavit.
