Opinion

No. 112738.

October 27, 1998.

Summary Dispositions October 27, 1998.

In lieu of granting leave to appeal, the order of the Court of Appeals dismissing the claim of appeal is vacated and the case is remanded to that Court. MCR 7.302(F)(1). On remand, the Court is to establish a schedule for the parties to brief the issue whether a claim of appeal is an appropriate method for invoking the jurisdiction of the Court of Appeals in this case and to consider the briefs filed by the parties in accordance with the schedule. The Court is to decide the issue of jurisdiction in a separate order or decision and, if it deems the matter of sufficient interest to bench and bar, publish that order or decision. Jurisdiction is not retained.
